Sample email to send to DOE to ask if your child’s data was breached

Illuminate has admitted that personal data of  820,000 students who attended NYC public schools going back to the 2016-17 school year was breached.  More on this here. Below is a message that NYC parents (or students if they are over 18) can send to DOE to ask them what personal information the vendor had access to about themselves, and what data was breached.

Cc: info@studentprivacymatters.org  and to yourself (so you have a copy of the email and the date)

To whom it may concern:

My name is [x].  My child, [name], attended [school name] during the following school years [years].  [If up to the present school year, make that clear as well.]

  1.  Please send me all the personal data that Pupil Path/Skedula collected and had access to for my child, including any communications that included their name and/or other personally identifiable information.

This is my right under the federal student privacy law FERPA and NY State Education Law-2D.

  1. I would also like to know which if any of these personal elements breached and when this occurred.

To the extent that #1 is available before #2, please provide this information as soon as possible.  Note: federal and state law requires a timely response to any request for student records, no later than 45 days.

 If you child is 18 or over, you should also ask them to send an email, because it is unclear whether as a parent you still have access to this information, but they do:
